By clicking "I agree," creating an account, or using our service, you accept these Terms and Conditions, our Privacy Policy, and our End User License Agreement (accepted at time of purchase). If you do not agree to these Terms, you must not use our service.

2. Age Restrictions

Our service is intended for users who are 13 years of age or older. If you are under 18, you represent that you have obtained parental or guardian consent to use this service. We do not knowingly collect personal information from children under 13.

3. Service Description

Tourlu is an AI-powered city tour guide service that generates personalized tour itineraries based on your preferences, schedule, and location. Our service uses artificial intelligence to suggest routes, stops, descriptions, and estimated travel times.

4. Best Effort Service - Accuracy Disclaimer

IMPORTANT: All information provided by Tourlu is provided on a "best effort" basis and may not be accurate, complete, or current.

You must review and verify all information independently before relying on it. This includes, but is not limited to:

  • Hours of Operation: Business hours, opening times, and availability may be incorrect or subject to change without notice.
  • Tickets and Reservations: Our service does not guarantee that tickets are available, required, or correctly priced. Some attractions may require advance reservations or tickets that are not mentioned in your itinerary.
  • Route Information: Directions, travel times, and routes are estimates only and may not account for current traffic, road closures, construction, or transit schedule changes.
  • Location Accuracy: Stop locations, addresses, and coordinates are provided for reference only and should be verified using a reliable mapping service.
  • Business Information: Venue names, addresses, contact information, and descriptions may be outdated or inaccurate.

We strongly recommend that you verify all critical information directly with venues, official websites, or reliable sources before your tour.

5. No Warranty or Guarantee

TOURLU PROVIDES ITS SERVICE "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

We provide the service on a "best efforts" basis and do not guarantee uptime, availability, or performance.

6. User Responsibility

You are solely responsible for:

  • Reviewing and verifying all information in your itinerary before and during your tour
  • Checking current hours of operation, ticket requirements, and reservation needs
  • Following local laws, regulations, and safety guidelines
  • Your personal safety and the safety of others while following any itinerary
  • Ensuring you have proper transportation, insurance, and necessary permissions for your activities

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOURLU, ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO:

  • Inaccurate or outdated information about venues, hours, or locations
  • Missed reservations, tickets, or entry requirements
  • Navigation errors, incorrect routes, or travel time miscalculations
  • Business closures, changes in operating hours, or venue unavailability
  • Any injury, loss, or damage resulting from following an itinerary

These services have their own terms of service. You agree to comply with those terms. We are not responsible for the accuracy or availability of third-party services.

9. Account and Token Package Terms

Token Package System

Tourlu uses a prepaid token package system. Users receive token packages that can be used to generate tours. Token packages expire after a specified number of days from the date of activation, not from the date of purchase.

Package Activation:

  • If you already have an active token package when you purchase a new one, the new package will be queued and will not activate until your current package is either fully used or expires.
  • The expiration period for a queued package begins only when it becomes active.
  • Once purchased, your package terms (token amount, expiration days) are fixed and will not change.

Expiration:

  • Unused tokens expire when the package expires.
  • Available packages and pricing for new purchases may change at any time without notice.

Payment Processing

  • Payments are processed securely through Stripe
  • All prices are in USD unless otherwise stated
  • GST (Goods and Services Tax) is charged for purchases by Canadian residents only
  • You agree to provide accurate billing information
  • Currency conversion, if applicable, will be handled by your payment provider
  • In case of payment disputes or chargebacks, we reserve the right to suspend your account pending resolution

Refund Policy

Refunds are considered on a case-by-case basis at our discretion. We may provide refunds in exceptional circumstances, such as:

  • System failures or technical issues that prevent you from using the service during a trip
  • Documented service outages that significantly impact your ability to use purchased tokens

Token packages are generally non-refundable. Refunds are not automatic and are evaluated based on the specific circumstances of each case.

Important: If you delete your account while you have purchased tokens, those tokens will be lost and are not refundable.

10. Prohibited Uses

You agree not to:

  • Use the service for any unlawful purpose
  • Attempt to reverse engineer or extract our AI models or algorithms
  • Share, resell, or redistribute itineraries for commercial purposes without permission
  • Use automated systems to abuse rate limits or generate excessive tours
  • Violate any applicable laws or regulations

11. Intellectual Property

All content generated by Tourlu, including itineraries, descriptions, and route information, is provided for your personal, non-commercial use. You retain ownership of your user data, but grant us a license to use it to provide and improve our service.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes. Continued use of the service after changes constitutes acceptance of the new Terms.

13. Termination and Account Cancellation

Account Cancellation

You may stop using the service at any time by deleting your account. Account deletion is immediate and irreversible.

Termination by Us

We reserve the right to suspend or terminate your account for violation of these Terms or for any other reason at our discretion.

Account Deletion

If you choose to delete your account, all your data will be deleted immediately. Any purchased tokens remaining in your account will be lost and are not refundable.

14. Dispute Resolution

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.

Any disputes arising from or related to these Terms or the service shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.

15. Data Breach Notification

In the event of a data breach that may affect your personal information, we will notify you and relevant authorities as required by applicable law.

16. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy and End User License Agreement, constitute the entire agreement between you and Tourlu regarding the service.

Severability: If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will remain in full effect.

Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.

Assignment: You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

Force Majeure: We will not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, internet failures, or acts of government.
